I. The District Court improperly denied suppression of evidence obtained from the illegal search of Decoteau's vehicle.
II: The District Court improperly denied suppression of evidence by allowing the State to present testimony even though the State never submitted a brief or proper response to Decoteau's Motion.
III: The District Court improperly denied suppression of evidence by requiring Decoteau to submit supporting facts in affidavit form.
Appellee's Statement of the Issues:
I. The district court properly denied suppression of evidence where the search of a motor vehicle was legal
II. The district court had authority to allow an extension of time for the filing of a response brief.
III. A district court cannot decide the merits of a motion without a factual record.
