Appellant's Statement of the Issues: 1.The lower court's Order granting the Defendant-Appellee's suppression motion was clearly erroneous A. The standard of review for probable cause to issue a search warrant is whether, based on the totality of the circumstances, the magistrate had a substantial basis for finding probable cause. B.The good faith exception to the exclusionary rule is applicable. Appellee's Statement of the Issues: I. The trial court correctly granted Grager's Motion to Suppress Evidence based on a finding of insufficient probable cause to support the issuance of a search warrant for Grager's residence. II. The State has raised police "Good Faith" for the first time on appeal and this Court must reject the State's argument as having been waived because it was not raised in the court below. | ||||||
