Issues: Appellant's Statement of the Issues:
I. In a prosecution for Surreptitious Intrusion, under Subsection (d) of Section 12.1-20-12.2 N.D.C.C., did the Complaint charge an offense if it failed to allege that the surreptitious recording of a person undressing in a private place was done "through the window or other aperture" of that place?
II. Did the Trial Court err in refusing to arrest judgment because all twelve counts of the Complaint in the action failed to allege an offense?

Appellee's Statement of the Issues:
1. Do the words through the window or other aperture constitute an essential element of the crime of surreptitious intrusion?
2. Is the omission of these words from the complaint harmless error if the record shows the defendant was not prejudicially misled.
