I. Admission of testimonial hearsay was improper.
A. The Sixth Amendment prohibits introduction of testimonial hearsay without confrontation.
B. The nurse's affidavit is testimonial.
II. N.D.C.C. 39-20-07 does not adequately protect the right of confrontation.
A. The State bears the burden to establish an affirmative waiver of a constitutional right.
B. A waiver theory is inapplicable.
Appellant's Reply Brief Issues:
A. The nurse's statement is testimonial.
B. The nurse's statement is an affidavit.
C. Friedt's opportunity to subpoena the nurse is of no concern to the right of confrontation.
