Code was not an unconstitutional delegation of judicial authority? 2. Did the trial court commit reversible error when it determined that Chapter 25-03.3 violates the equal protection clauses of the united states and North Dakota constitutions? Appellee's Statement of the Issues: I. N.D.C.C. 25-03.3-17 does not violate the separation of powers doctrine as the district court retains authority to determine whether to release a committed individual. II. N.D.C.C. 25-03.3-17 does not violate the equal protection doctrine as the State is not required to treat sexually dangerous individuals in the same manner as individuals committed under other mental health commitments. Appellee's Statement of the Issues: Amicus Issues: 1. Whether the trial court correctly determined N.D.C.C. 25 03.3 17 is not an unconstitutional delegation of judicial authority. 2. Whether the trial court correctly determined N.D.C.C. ch. 25 03.3 does not violate the Equal Protection Clauses of the United States and North Dakota Constitutions. | |||||||||
