Respondent's Statement of the Issues:
The Petition for Supervisory Writ filed by Forum Communications Company (hereinafter "The Forum") presents three issues for review:
1. Should the North Dakota Supreme Court exercise its original jurisdiction?
2. If the Court decides to exercise its original jurisdiction, should the names of the jurors who were seated in the second trial in State v. Gibbs be made public prior to the resolution of the pending appeal in that case?
3. If the Court decides to exercise its original jurisdiction, should the completed juror questionnaires in the second trial in State v. Gibbs be made public prior to the resolution of the pending appeal in that case?
Issues of Respondent State of North Dakota
Should the names of the jurors who were seated in the second trial in State v. Gibbs be made public at this point?
