I. Whether the trial court erred by denying an evidentiary hearing on a motion for change of custody when the movant provided sufficient competent evidence to establish a prima facie case warranting an evidentiary hearing.
II. Whether the trial court erred in misapplying the law by weighing the conflicting evidence in the affidavits.
III. Whether the trial court erred in finding that a mature child's preference to live with one parent does not constitute a material change of circumstances sufficient to raise a prima facie case for change of custody, entitling the movant to an evidentiary hearing.
