1. May the City of Fargo approve a tax increment financing development or renewal plan not conforming to the general plan of the municipality as a whole as required by N.D.C.C.  40-58-06(4)?
2. May the City of Fargo approve a tax increment financing development or renewal plan which results in unfair competition and that the agreement is not in the best interest of the municipality as a whole in violation of N.D.C.C.  40-58-20.1?
3. May the City of Fargo create tax increment financing for residentially zoned property in violation of N.D.C.C.  40-58-20.1(1)?

Reply Brief Issues:
Without filing a notice of appeal or expressing dissatisfaction with the three (3) issues on appeal [N.D.R.App.P. 28(c)] set forth by William F. Rakowski [hereinafter "RAKOWSKI"], the City of Fargo attempts to identify a single general issue failing to recognize the three (3) specific RAKOWSKI issues are necessarily subsumed. The City of Fargo ["FARGO"] could have been more general by merely phrasing the issue, "Whether the City of Fargo can exercise any authority?" RAKOWSKI chooses specificity over generality.

Appellee's Statement of the Issues:
Whether the City of Fargo properly exercised its authority in approving Tax Increment Financing District No. 2008-01.
