3.Whether genuine issues of material fact existed which would render summary judgment inappropriate; and
4.Whether the Court erred in striking Appellant's counterclaim;

1. Whether the District Court properly granted Summary Judgment to the Plaintiff.
2. Whether the District Court properly applied the law of contribution pursuant to N.D.C.C. 9-01-08.
