The District Court Erred in Dismissing the Charges Against the Defendant Based upon the Grounds of Lack of Jurisdiction: A.Section 27-20-34(8), N.D.C.C., and not Section 27-20-34(5), N.D.C.C. is the applicable statute, and Section 27-20-34(8), N.D.C.C., provides a jurisdictional basis for the criminal charges in district court. B.The State has met all of the elements of 27-20-34(8), N.D.C.C. and, therefore, the district court has jurisdiction over the Defendant.
