Appellant's Statement of the Issues:
1. The trial court erred in granting the State's motion in limine which prohibited the defendants from raising factual and/or legal defenses at trial.
2. The trial court erred in requiring the Defendant and Appellant William Dethloff to pay restitution in the sum of $8,500.00.
Appellee's Statement of the Issues:
I. The Defendant was not entitled to any Defenses as to Depredation, Self-Defense, Excuse or otherwise.
A. Depredation, as contained in N.D.C.C. 20.1-07-04, does not apply to this matter.
B. The Defendant was not entitled to a defense or affirmative defense of mistake or excuse.
C. Constitutional Defense
II. The Court did not err by awarding restitution in the Dethloff case.
