Whether res judicata, law of the case and related legal concepts have cut off WSI's ability to reconsider CARLSON's workers compensation benefit entitlement established in Carlson I? 3. Whether the Administrative Law Judge properly applied the "common law" employment test if the entitlement question is subject to reconsideration after Carlson I? 4. Whether CARLSON is entitled to attorneys fees pursuant to N.D.C.C. 28-32-50? 5. Whether CARLSON's health insurer should be allowed to intervene to obtain direct reimbursement from WSI for medical expense payments? Appellee's Statement of the Issues: [1] Whether res judicata/law of the case precluded WSI from exercising its continuing jurisdiction under N.D.C.C. 65-05-04 after Carlson v. Workforce Safety and Insurance, 2009 ND 87. [2] Whether there were procedural and/or substantive due process violations in connection with these proceedings. [3] Whether the ALJ could reasonably determine that Carlson was an independent contractor. [4] Whether the ALJ properly denied intervention from Blue Cross-Blue Shield of North Dakota.
