Issues: Appellant's Statement of the Issues:
1. Whether N.D.C.C.  54-44.3-12.2's directive of proper service upon HRMS is jurisdictional given that: A. N.D.C.C.  28-32-42, which governs appeals of orders resulting from "any proceeding heard by an administrative agency[,]" unambiguously excludes service upon HRMS as unnecessary to the perfection of an appeal; and B. Proper service upon HRMS is for the exclusive purpose of certifying the record of proceedings to the district court.
2. Assuming, arguendo, that N.D.C.C.  54-44.3-12.2 is jurisdictional, whether compliance with N.D.R.Civ.P. 4(d)(2)(F)(ii) in serving an assistant attorney general constitutes proper service upon HRMS, an agency of the state.
3. Whether N.D.C.C.  28-32-50(1) mandates an award of attorney fees and costs to Meier if the Court finds in his favor, regardless of whether DHS acted without substantial justification.
