2. Whether constitutional arguments not raised in Hopfauf's first appeal (i.e., pre-termination due process and excessive fines) may be heard in his second appeal.
3. Whether Hopfauf's failure to appeal the district court's remedy for ex parte communications (i.e., a new hearing) precludes further review of the issue.
