RE: Rule 32, N.D.R.Crim.P., Sentence and Judgement
The Committee considered and approved changes to Rule 32 at the January meeting. Mr. Mack requested that new language be added to the rule allowing a probation revocation proceeding to be transferred under the procedure in Rule 20 (Transfer from the County for Plea and Sentence). A new Rule 32 proposal incorporating the language requested by Mr. Mack is attached. The new amendments are at lines 137-139 of the rule and 181-183 of the Explanatory Note -- the other underscored language in the proposal was approved by the Committee at the January meeting.
