RE: Rule 41, N.D.R.Crim.P., Search and Seizure
At the January meeting, the Committee instructed staff to redraft the proposed amendments to Rule 41 to include form and style changes based on current Rule 41 rather than on Fed.R.Crim.P. 41. The proposed amendments to Rule 41 are attached. The amendments are form and style amendments in the spirit of the December 2002 federal criminal rule amendments. The goal of the amendments is to improve the form and style of the rule without eliminating or altering features unique to the North Dakota rule.
