RE: N.D.R.Civ.P., Discovery Methods
Proposed amendments to N.D.R.Civ.P. 30, 31, 33, 34 and 36 are attached. Under these amendments, existing provisions allowing free use of discovery methods beginning any time after commencement of the action would be deleted and replaced by language based on the federal rules. The new language, in general, would not allow use of depositions, interrogatories, requests for production, or requests for admission until after the mandatory discovery planning conference under Rule 26 (f) was completed.
