RE: Rule 612, N.D.R.Ev., Writing or Object Used to Refresh a Witness's Memory
Form and style amendments to Rule 612 consistent with the 2011 federal amendments are proposed. The amendments are not intended to change any result in any ruling on evidence admissibility.
This rule is significantly reorganized and condensed, with the essential elements preserved in a tighter form. The Committee may wish to examine the rule closely to make sure nothing was lost in condensation. Allowing the use of an object to refresh memory is retained, even though this is not included in the federal rule.
