RE: Rule 48, N.D.R.Civ.P., Number of Jurors; Verdict
Staff has prepared amendments to Rule 48 based on the December 1, 2009, amendments made to the federal rules. The amendment to Rule 48 adds a provision similar to that in corresponding N.D.R.Crim.P. 31(d) that allows a court to poll the jury individually on its own and requires a poll at a party’s request.
The proposed amendments to Rule 48 are attached. The proposed amendments are highlighted.
