RE: Rule 8.2, N.D.R.Ct., Interim Orders in Domestic Relations Cases
At its January meeting, the Committee discussed comments made by attorney Tom Slorby regarding the timing provisions in Rule 8.2(e)(3). Staff was instructed to prepare an amendment to Rule 8.2 based on the timing provisions in Rule 303.03, Minn. Gen. R. Prac., Motion Practice. The proposed amendment allows a movant to respond if the opposing party raises new issues in its response to the initial motion. Form and style amendments were also made to the rule.
The proposed amendments to Rule 8.2 are attached along with a copy of Minn. Gen. R. Prac. 303 and a copy of the letter from Tom Slorby.
