RE: Rule 8.13, N.D.R.Ct., In Chambers Interview of Child in Custody or Visitation Case
At the Supreme Court's request, staff drafted a new rule for district courts to use when planning to conduct an in chambers interview of a child in a custody or visitation case. The rule is modeled after guidelines adopted by the Oklahoma Supreme Court in Ynclan v. Woodward, 2010 OK 29, ¶ 20. See also Oklahoma Rule 1.33(f).
A copy of the proposed rule and a copy of Ynclan v. Woodward and Oklahoma Supreme Court Rule 1.33 are attached.
