Judicial Referee John Grinsteiner will present a one-hour program to provide information to parties who plan to participate in a small claims court proceeding. The program will be held at 2 p.m. on Wednesday, March 27, at the Burleigh County Courthouse. No registration is required.
Grinsteiner will provide an overview of the small claims court procedures and the time line for required actions. He will also provide information about what types of evidence may be presented and how evidence should be presented during a hearing.
Small claims court is a division of district court where cases may be heard that involve recovery of money or cancellation of an agreement if it is proven there was fraud, deception, misrepresentation, or false promise. Small claims court was established so citizens could present their own cases to the court without the assistance of an attorney.
Claims may be filed in small claims court if the amount claimed is not more than $10,000. Parties who choose to proceed in small claims court do not have the right to a jury trial or to appeal the decision of the judge or referee.
