Proposed Amendments to North Dakota Rules of Civil Procedure 62, and North Dakota Rules of Appellate Procedure 8
On November 6, 2003, John M. Olson filed a Petition (.pdf document) to amend N.D.R.Civ.P. 62 and N.D.R.App.P. 8 on behalf of his client, Philip Morris USA. On November 12, 2003, the proposed amendments were referred to the Joint Procedure Committee. The Joint Procedure Committee filed its report on July 9, 2004, with proposed amendments incorporating Olson’s proposed amendments as well as the Committee’s suggested amendments. A copy of the proposed amendments is attached.
ORDERED, that a hearing be held on the proposed amendments, Monday, October 4, 2004, at 2:45 p.m., in the Ralph J. Erickstad Courtroom of the Supreme Court, at the State Capitol in Bismarck, North Dakota. Time for personal appearances will be limited. Any person wishing to appear must notify Penny Miller, Clerk of the Supreme Court, at least three days prior to the scheduled hearing. Any person wishing to comment on the proposed amendments may do so in writing prior to the hearing.
