On February 9, 2009, the Joint Committee on Attorney Standards filed a request for a proposed rule amendment to Rule 1.8 of the North Dakota Rules of Professional Conduct prohibiting attorneys from serving as both legal counsel and personal representative of an estate. A copy of the proposed rule is attached. The Court considered the matter, and
ORDERED, any person wishing to comment on the proposed amendments may do so in writing before Monday, March 16, 2009. The Supreme Court of the State of North Dakota convened February 11, 2009, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, the Honorable Carol Ronning Kapsner, the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order.
