On June 1, 2009, the Joint Procedure Committee filed proposed amendments to Rule 4, North Dakota Rules of Civil Procedure, to Rules 8.2, 8.3, 8.4, 8.5, 8.6 and 8.7, North Dakota Rules of Court, and to forms and appendices attached to certain rules, relating to eliminating the term "custody" in the family law context and replacing it with the term "parenting." A copy of the Amendments is attached.
On April 27, 2009, the Custody and Visitation Task Force filed non-procedural proposed amendments to Rule 4, North Dakota Admission to Practice Rules, and to Rules 8 and 27, North Dakota Supreme Court Administrative Rules relating to eliminating the term "custody" in the family law context and replacing it with the term "parenting." A copy of the Amendments is attached. The Court considered the matters, and
ORDERED, that proposed amendments to Rule 4, North Dakota Rules of Civil Procedure; Rules 8.2, 8.3, 8.4, 8.5, 8.6 and 8.7, Appendix to 8.6, and Appendices C and D to 8.3, North Dakota Rules of Court; Rule 4, North Dakota Admission to Practice Rules; and Rules 8 and 27, and Appendix to 41, North Dakota Supreme Court Administrative Rules are APPROVED, as further amended by the Court, effective August 1, 2009, subject to comment. Address written comments to Penny Miller, Clerk of the Supreme Court, 600 E. Boulevard Ave., Bismarck, ND 58505-0530, no later than Friday, July 31, 2009.
The Supreme Court of the State of North Dakota convened this 3rd day of June, 2009, with the Honorable Gerald W. VandeWalle, Chief Justice, the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, the Honorable Carol Ronning Kapsner and the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order.
