On July 14, 2009, the Joint Procedure Committee filed a
request for proposed rule amendments to
Rule 3.4 of the North Dakota Rules of Court-Privacy Protection for Filings Made with the Court, with Appendix H, and
Rule 41 of the North Dakota Supreme Court Administrative Rules-Access to Court Records.
Notice of Comment was published on July 15, 2009. Following receipt of comments, the Court referred the matter back to the Joint Procedure Committee. On October 7, 2009, the Joint Procedure Committee
requested additional amendments and also included proposed rule amendments to
Rule 8.2 of the North Dakota Rules of Court-Interim Orders in Domestic Relations Cases, North Dakota Rules of Appellate Procedure
28-Briefs and
32-Form of Briefs, Appendices, and Other Paper. The Court considered the matter, and
ORDERED, that the proposed amendments to
N.D.R.Ct. 3.4 and
8.2, N.D.R.App.P.
28 and
32, and N.D.Sup.Ct.Admin.R.
41, as further amended by this Court, and
Appendix H to the N.D.R.Ct., are ADOPTED, effective March 1, 2010. A copy of the rules, as amended, is attached.
The Supreme Court of the State of North Dakota convened December 2, 2009, with the
Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, the Honorable Carol Ronning Kapsner, the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order.
