Analytical Report Admission: Confrontation

By Order dated December 16, 2009, and effective February 1, 2009, the Supreme Court adopted Rule 707 of the North Dakota Rules of Evidence subject to comment. The Court adopted the rule in response to the United States Supreme Court's decision in Melendez-Diaz v. Massachusetts, 129 S.Ct. 2527 (2009). Following review of the comments filed, the matter was referred to the Joint Procedure Committee for review and recommendation. On October 4, 2010, the Joint Procedure Committee proposed amendments to Rule 707. The Court considered the matter, and

ORDERED, that the proposed amendments to Rule 707 of the North Dakota Rules of Evidence, as further amended by this Court are ADOPTED, effective March 1, 2011. A copy of the amended rule is attached.

The Supreme Court of the State of North Dakota convened December 21, 2010, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, the Honorable Carol Ronning Kapsner, and the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order.
