On August 30, 2010, the Joint Procedure Committee filed a Petition for Adoption, Amendment or Repeal of Court Rules with proposed amendments to North Dakota Rules of Civil Procedure 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 30.1, 31, 32, 33, 34, 35, 36, 37, 38, 39, 39.1, 40, 41, 42, 43, 44, 44.1, 46, 47, 48, 49, 50, 51, 52, 53, 54, 55, 56, 57, 58, 59,60, 61, 62, 63, 64, 66, 67, 68, 69, 70, 71, 77, 80, 81, 83, 84, 86, Table B, Form 1, and Form 17; North Dakota Rules of Appellate Procedure 2.1, 2.2, 4, 10, 12, 25, 26, 27, 28, 30, and 31; North Dakota Rules of Criminal Procedure 12.1, 24, 26.1, 29, 32, 33, 34, 37, 41, 45, and 47; North Dakota Rules of Court 3.2, 7.1, 8.2, 8.3, 8.5, 8.8, and Appendix A; and North Dakota Supreme Court Administrative Rules 13 and 55, and Orders 16 and 17. Subsequently, the Committee requested additional amendments to North Dakota Rules of Civil Procedure. 13, 48, and 55, and North Dakota Rules of Court 7.1, 8.2, and 8.5. A Notice of Hearing was published, comments were received, and a hearing was held on October 20, 2010. Following the hearing, additional amendments to North Dakota Rules of Court 8.5 were requested on behalf of the Joint Procedure Committee. The Court considered the matter, and

ORDERED, that the proposed amendments, to North Dakota Rules of Civil Procedure 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 30.1, 31, 32, 33, 34, 35, 36, 37, 38, 39, 39.1, 40, 41, 42, 43, 44, 44.1, 46, 47, 48, 49, 50, 51, 52, 53, 54, 55, 56, 57, 58, 59,60, 61, 62, 63, 64, 66, 67, 68, 69, 70, 71, 77, 80, 81, 83, 84, 86, Table B, Form 1, and Form 17; North Dakota Rules of Appellate Procedure 2.1, 2.1, 4, 10, 12, 25, 26, 27, 28, 30, and 31; North Dakota Rules of Criminal Procedure 12.1, 24, 26.1, 29, 32, 33, 34, 37, 41, 45, and 47; North Dakota Rules of Court 3.2, 7.1, 8.2, 8.3, 8.5, 8.8, and Appendix A; and North Dakota Supreme Court Administrative Rules 13 and 55, and Orders 16 and 17, as further amended by the Court, are ADOPTED, effective March 1, 2011.

The Supreme Court of the State of North Dakota convened the 21st day of December, 2010, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, the Honorable Carol Ronning Kapsner and the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order.
