On February 9, 2011, Mike Hagburg, Staff Attorney assigned to the Joint Procedure Committee, requested the Court to consider amendments to Rule 10, N.D.R.Civ.P., Form of Pleadings and Rule 17, N.D.R.Civ.P., Parties Plaintiff and Defendant - Capacity, to correct oversights made in the published versions when the Court approved amendments effective March 1, 2007. The Court considered the matter, and
ORDERED, that the proposed amendments, to North Dakota Rules of Civil Procedure 10 and 17 are ADOPTED, effective March 1, 2011.
The Supreme Court of the State of North Dakota convened the 16th day of February 16, 2011, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Carol Ronning Kapsner and the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order. The Honorable Mary Muehlen Maring, being unavoidably absent, did not participate.
