On May 9, 2011, the Joint Procedure Committee submitted proposed amendments to Rule 3, N.D.R.Crim.P., The Complaint; Rule 5, N.D.R.Crim.P., Initial Appearance Before the Magistrate; and Rule 7, N.D.R.Crim.P., The Indictment and the Information. The proposed amendments are consistent with recent legislative amendments to N.D.C.C. § 29-04-05 and related statutes. A copy of the proposal is attached.
ORDERED, the proposed amendments to N.D.R.Crim.P. 3, 5, and 7 are ADOPTED, effective August 1, 2011, subject to comment. Any written comments must be submitted to Penny Miller, Clerk of the Supreme Court, at supclerkofcourt@ndcourts.gov or 600 E. Boulevard Ave., Bismarck, ND 58505-0530, no later than Monday, August 1, 2011. The Supreme Court of the State of North Dakota convened this 29th day of June, 2011, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, the Honorable Carol Ronning Kapsner and the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order.
