Borgen v. Hanson
Gierke, Justice.
Dora Hanson and Kenneth Sanden appeal from a summary judgment enjoining them from interfering with Dennis L. Borgen's use of certain land in Cass County and quieting title to that land to Borgen. The judgment is affirmed under Rule 35.1(a)(1), N.D.R.App.P.
Additionally, because we have determined that the appeal is frivolous and because the district court warned these pro se appellants that their legal arguments were "obviously wrong," we award Borgen double costs as well as attorney fees in the amount of $250. United Bank of Bismarck v. Young, N.W.2d (Civil No. 11,263, N.D. 1987); See Mitchell v. Preusse, 358 N.W.2d 511 (N.D.1984).
