Orvis H. Johnson appealed from an order dismissing with prejudice his medical malpractice suit against Roger F. Kennedy, M.D.; Bismarck Neurologic Associates, Ltd., Timothy Gold, M.D.; Morgan and Associates, M.D.'s, P.C.; G.J. Kavlie, M.D.; Mid Dakota Clinic, P.C.; and St. Alexius Medical Center. NDCC 28-01-46 requires that a medical malpractice claimant obtain an "admissible expert opinion to support the allegation of professional negligence within three months of the commencement of the action or at such later date as set by the court. Although Johnson was given several added months to do so, the trial court determined that he failed to file an admissible expert opinion "to support the allegation[s] of professional negligence." The trial court did not abuse its discretion. We affirm. NDRAppP 35.1(a)(4).
