Orville Latendresse appeals from a Ward County Court judgment of conviction for issuing a bank check without sufficient funds in violation of section 6-08-16, N.D.C.C. Pursuant to Rule 35.1(a)(7), N.D.R.App.P., and this Court's prior decisions in State v. Latendresse, 459 N.W.2d 234 (N.D. 1990), State v. Latendresse, 450 N.W.2d 781 (N.D. 1990), and State V. Latendresse, 464 N.W.2d 205 (N.D. 1990), an unpublished summary opinion, Latendresse's conviction is affirmed. The issues raised in this case not raised and decided in the above cases are deemed to be without merit.
The State's motion for costs and reasonable attorney's fees pursuant to Rules 38 and 39(h), N.D.R.App.P., is denied.
