Van Beek v. Friese Manufacturing, Inc.
Per Curiam.
Jerry Van Beek appeals from summary judgment dismissing with prejudice his amercement claim under NDCC 28-21-19 (repealed 1993) against the McLean County Sheriff, Arlin Thompson. We believe that the evidence in this case, in conjunction with the clear and convincing evidentiary standard,see Farmers' Nat'l Bank v. Wright, 209 N.W. 796, 798 (N.D. 1926), is such that a jury could not reasonably find for Van Beek. See In re Estate of Stanton, 472 N.W.2d 741, 743 (N.D. 1991). Therefore, we affirm under NDRAppP 35.1(a)(6).
