Wayne Kubista appealed from a district court judgment affirming the North Dakota Department of Transportation's administrative decision suspending Kubista's driving privileges for 365 days for violating Section 39-08-01, N.D.C.C. We affirm under Rule 35.1(5) and (7), N.D.R.App.P., and Ding v. Director, North Dakota Department of Transportation, 484 N.W.2d 496 (N.D. 1992).
