William F. Hodny
Hoffner v. Bismarck Public School District
, 1999 ND 3,
589 N.W.2d 195
The notice of contemplated nonrenewal of a teacher's contract must list reasons for nonrenewal which are drawn from findings arising from the teacher's written evaluations.
In determining whether to nonrenew a teacher's contract, the school board is not limited to problems identified in the teacher's most recent evaluation, but may consider matters raised in prior evaluations.
Larsen v. Comm. on Medical Competency
, 1998 ND 193,
585 N.W.2d 801
An administrative agency must consider favorable and
unfavorable evidence.
If authorized by law and justified in fact, imposition
of a regulatory sanction by an administrative agency
will not be disturbed on review, absent a manifest
abuse of discretion.
A district court does not err by denying a party's
motion for leave to offer additional evidence under
N.D.C.C. 28-32-18 when the party had an opportunity to
attend the administrative hearing and present evidence,
but failed to do so.
State v. Webb
, 1998 ND 127,
585 N.W.2d 581
Criminal Judgment and Commitment for Conspiracy to Deliver a
Controlled Substance (Methamphetamine) summarily affirmed under
N.D.R.App.P. 35.1(a)(4).
State v. Black Cloud
, 1998 ND 81,
585 N.W.2d 581
DUI conviction summarily affirmed under N.D.R.App.P. 35.1 (a)(3)
and (4).
State v. Wicks
, 1998 ND 76,
576 N.W.2d 518
Criminal defendant is denied right to counsel when appointed
attorney withdraws on the day of trial because of a conflict of
interest created by client and client is required to proceed pro
se, record reflects "forced waiver" was not knowing and
intelligent.
Appointed counsel may continue representation
of client despite client's filing of disciplinary complaint.
State v. Jorde
, 1998 ND 63,
576 N.W.2d 524
Criminal Judgment and sentence of two years for corruption or
solicitation of a minor summarily affirmed under N.D.R.App.P.
35.1(a)(4), (7).
Wahl v. Morton Co. Social Service Board
, 1998 ND 48,
574 N.W.2d 859
In determining medicaid eligibility, the Department of Human
Services' use of gross, rather than net, unearned income to
compute the community spouse's resource allowance is a reasonable
and appropriate application of the medicaid laws.
North Dakota, as a section 209(b) state, can use more restrictive
medicaid eligibility requirements than are used under the
supplemental security income program.
Delay in holding a fair hearing and providing an incomplete
notice of hearing do not constitute reversible errors, absent a
showing of substantial prejudice.
Hopfauf v. State
, 1998 ND 30,
575 N.W.2d 646
Proceedings under the Uniform Post-Conviction Procedure Act are
civil in nature.
Whether sought in a motion for new trial or in an application for
post-conviction relief, a new trial on the ground of newly
discovered evidence will be granted only if the evidence is of
such a nature that it would probably produce an acquittal at a
retrial.
Conclusory allegations about trial counsel's failure to call
certain witnesses at trial, without identifying the potential
witnesses, indicating what their testimony would have been, or
indicating how their testimony might have affected the outcome of
the trial, are insufficient to raise a genuine issue of material
fact requiring a hearing or relief under the Uniform
Post-Conviction Procedure Act.
Hopfauf v. N.D. Workers Comp.
, 1998 ND 40,
575 N.W.2d 436
Remand is necessary where it is unclear whether ALJ correctly
applied the law.
On appeal of an administrative agency order, the courts do not
address issues not raised at administrative hearing and in
specifications of error.
Dean v. ND Workers Compensation Bureau
, 1997 ND 165,
567 N.W.2d 626
Workers Compensation Bureau could reasonably have reached its
factual conclusion that an applicant for benefits intentionally
made material false statements in connection with her claim.
Austin v. Towne
, 1997 ND 59,
560 N.W.2d 895
Motion under N.D.R.Civ.P. 59(j) was timely. Defendant was not
entitled to credit on his child support arrearage for social
security dependency payments.
Medcenter One v. ND State Board of Pharmacy
, 1997 ND 54,
561 N.W.2d 634
When there are no factual issues to be determined by an
administrative agency, a nonagency party's failure to exhaust
administrative remedies does not preclude an action for
declaratory relief to construe an unambiguous statute.
The exemptions to the requirements for majority ownership by a
pharmacist in NDCC 43-15-35(5) are unambiguous and do not
differentiate between retail and hospital pharmacies.
NDCC 28-32-21.1 authorizes attorneys' fees in any civil judicial
proceeding for judicial review of a final agency order, or for
judicial review under NDCC Ch. 28-32 of the legality of agency
rulemaking action or a rule adopted by an agency, if the court
finds in favor of the nonagency party and, in the case of a final
agency order, determines the agency acted without substantial
justification.
Ingalls v. Paul Revere Ins.Group
, 1997 ND 43,
561 N.W.2d 273
There was evidence for the jury to reasonably find that the
insured did not misrepresent his income and that the insurer's
decision to rescind a disability income insurance policy for
income misrepresentation was not reasonable.
An insurer's presentation of an unreasonable defense may evidence
bad faith.
Whether an insurer has acted in bad faith in refusing to pay a
claim is a question for the trier of fact.
Absent an abuse of discretion, a trial court's determination on
the relevance of evidence will not be reversed on appeal.
There was substantial evidence for the jury's disability
findings.
There was evidence for the jury to find that unfair settlement
practices, prohibited by NDCC 26.1-04-03(9) and used by the
insurer, were performed with a frequency indicating a general
business practice, and the trial court did not err in submitting
the question to the jury.
The amount of damages for mental anguish rests in the jury's
sound discretion.
The jury's exemplary damages award is not excessive.
Ternes v. Ternes
,
555 N.W.2d 355 (N.D. 1996)
Where there is clear evidence of domestic violence
triggering a presumption against an award of custody under
Section 14-09-06.2(1)(j), N.D.C.C., the trial court must address
the issue even if not raised by the parties. However, when the
evidence does not facially demonstrate a clear showing of
domestic violence, the party claiming the presumption must raise
the issue in the trial court.
Praska v. State
,
562 N.W.2d 104 (N.D. 1996)
Dismissal of second post-conviction relief petition
summarily affirmed under N.D.R.App.P 35.1.
American Insurance Co. v. Midwest Motor Express
,
554 N.W.2d 182 (N.D. 1996)
Retrospective premium adjustments made annually
by an insurer under the terms of a workers compensation
insurance policy did not create a 'mutual open, and current
account' between the insurer and insured within the meaning of
Section 28-01-37, N.D.C.C., for purposes of determining when an
action accrues to start the running of the statute of
limitations.
Dean v. ND Workers Compensation Bureau
,
554 N.W.2d 455 (N.D. 1996)
In an appeal from an administrative agency decision,
'boilerplate' specifications of error do not comply with the
specificity requirements of Section 28-32-15(4), N.D.C.C.
Applying that holding prospectively, the Supreme Court remanded
to the district court to consider the appeal on its merits.
Diocese of Bismarck Trust v. Ramada Inc.
,
553 N.W.2d 760 (N.D. 1996)
The ten-year statute of limitations in Section
28-01-15(2), N.D.C.C., applies to an action for reformation of a
ground lease on the basis of mutual mistake. A reformation
action based upon mutual mistake accrues when the facts which
constitute the mistake have been, or in the exercise of
reasonable diligence should have been, discovered by the parties
seeking relief.
Under Section 32-04-17, N.D.C.C., reformation
of a contract is not available against third persons who have
acquired rights in good faith and for value.
If parties
make a mistake in reducing a prior agreement to writing, the
negligent failure to read the subsequent written agreement does
not preclude reformation of the agreement unless failure to read
the agreement was not in good faith or was not in accordance
with reasonable standards of fair dealing.
Earthworks, Inc. v. Sehn
,
553 N.W.2d 490 (N.D. 1996)
When the seller of a business agrees not to
engage in that business in the area for a reasonable length of
time, good will although not specifically mentioned passes as an
incident of the sale.
If each party prevails on certain
parts of a lawsuit, the trial court need not award costs
under Section 28-26-06, N.D.C.C., to either party.
Ohio Farmers Ins. Co. v. Dakota Agency, Inc.
,
551 N.W.2d 564 (N.D. 1996)
An insurance agency breached an agency agreement when
its employee issued performance bonds without the prior
approval of the bond insurance company.
Jacobs v. Dept. of Corrections & Rehab.
,
551 N.W.2d 779 (N.D. 1996)
The State Personnel Board's finding that an employee
was demoted for failing to complete his work in a timely
manner and not in retaliation for protected activity was
supported by a preponderance of the evidence.
