I. Authority and Effect of Policy
This policy is issued under Administrative Rule 35, which provides that
Court may adopt administrative policies governing the actions of juvenile courts and
personnel of the juvenile courts in North Dakota.
II. Statement of Policy
It is the policy of the North Dakota judiciary to review the necessity to detain a
in secure facilities within 24-hours after the child has been detained, excluding weekends
III. Conduct of Hearing
The hearing shall be conducted under the conditions set forth in Section
NDCC. The hearing may, at the discretion of the judge or referee conducting the hearing,
be held via telephone, telephone conference, or other electronic media.
IV. Intent of Policy
The sole intention of this policy is to expedite detention hearings. Violation of
policy is not cause for the dismissal of any case.
V. Violation of Policy
If the time standards of this policy are violated, the juvenile court officer
shall report the violation to the director of juvenile courts for the district or the judge of the
court who shall review the matter and take corrective action as deemed necessary.
