The Executive Committee of the Judicial Conference met on January 22, 2014. Chair
McCullough called the meeting to order at 8:16 a.m.
Judge Romanick moved that the minutes of the November 26, 2013 meeting be approved.
Seconded by Seconded by Justice Kapsner. The motion carried and the minutes were
Chair McCullough advised the committee that four people have applied for the vacant position
on the Pattern Jury Instruction Commission. Following discussion, Judge Haskell nominated
Judge Hagerty for appointment to the Pattern Jury Instruction Commission. The
nomination was seconded by Justice Kapsner. The nomination carried and Judge Hagerty
was appointed to the Commission. Judge McCullough will contact all four applicants to notify
them of the appointment.
Lee Ann Barnhardt, Director of Education and Communication, provided an update on the June
Judicial Conference which is held in conjunction with the annual meeting of the State Bar
Association. The annual meeting is scheduled for June 11–13, 2014 at the Avalon Event Center
in Fargo. The length and format of the annual meeting is being changed, but the changes have
not been finalized. Thursday afternoon will still be available for the Judicial Conference.
Because most of the sessions being proposed will be held outside the event center, Ms.
Barnhardt asked if the Committee would like to extend the education components of the
conference to encompass the full afternoon. Justice Sandstrom stated that a long-time goal of
the Supreme Court has been to encourage interaction with the bar as a means of fostering greater
collegiality so we should limit the length of the Judicial Conference in order to further that goal.
Ms. Barnhardt advised the Committee that the Judicial Education Commission committed to
integrating the Judicial Conference as much as possible with the annual meeting of the State Bar
Association when the decision was made to eliminate the North Dakota Bench and Bar Seminar.
After further discussion, it was the consensus of the Committee that we utilize our regular time
of Thursday from 1:45 p.m. to 3:15 p.m. for the Business Meeting of the Judicial Conference and
one educational session. Ms. Barnhardt said that we have scheduled an individual to do some
interpreter training in Fargo that week and suggested that the trainer could also do a session for
judges on working with interpreters in the courtroom. This suggestion was received favorably
by the Committee. Discussion then moved to the agenda for the Business Meeting. Jeanne
McLean has asked for time on the agenda to introduce herself and talk about the Citizen Access
Coordinator position. Justice Sandstrom will also need some time to discuss the need for
legislative proposals to be submitted in time for them to be developed before the next session.
There being no further business to come before the committee, the chair adjourned the meeting
at 8:39 a.m.
