Summary

Cash Aaland, Larry Bakko, and Penny Cirks (Owners) filed a motion for stay pending appeal from a district court amended order granting the Cass County Joint Water Resource District a right of entry on the Owners’ properties.

In September and December 2019, the District corresponded with the Owners seeking easements on their properties to conduct long-term monitoring for the F-M Diversion Project. After the Owners rejected the District’s offer, the District applied for a permit to enter the Owners’ properties to conduct environmental studies for the F-M Diversion Project through December 2021. The Owners opposed the District’s application, arguing the application was unduly overbroad and vague. After two hearings, the district court granted the application allowing the District entry on the Owners’ properties through December 2021. Following the court’s order, the Owners moved for a stay of the order until their appeal of the order is decided by this Court. The district court denied the Owners’ motion for a stay.

The Owners argue this Court should grant a stay of the district court’s order because they believe they are likely to succeed on appeal.
