Highlight
Underinsured motorist coverage in North Dakota is governed by statute.
When a statute's language is ambiguous, a court may consider the object sought to be obtained, former statutory provisions, and legislative history to determine the intention of the legislation.
The proper calculation of a reducing provision to underinsured motorist coverage requires the court to reduce the damages for the percentage of fault attributable to the plaintiff and other parties and then deduct the no-fault benefits paid.
