Case No. 2020-CV-01909
South Central Judicial District, Burleigh County
John W. Grinsteiner
Parties' Statement of Issues
Whether the district court erred by denying Mr. Brickle-Hicks’ petition for post-conviction relief.
Whether Hicks’s trial counsel’s representation was ineffective, and whether that ineffective representation prejudiced Hicks.
Morris Jerome Brickle-Hicks appeals from an order denying his application for post-conviction relief.
A jury found Brickle-Hicks guilty of murder on September 29, 2017. Brickle-Hicks was sentenced to life in prison without the possibility of parole. Brickle-Hicks appealed from the criminal judgment and this Court affirmed. State v. Brickle-Hicks, 2018 ND 194, 916 N.W.2d 781. Brickle-Hicks subsequently filed an application for post-conviction relief arguing he received ineffective assistance of counsel. At the post-conviction relief hearing the court heard testimony from Brickle-Hicks’ trial counsel and found Brickle-Hicks did not receive ineffective assistance of counsel.
Brickle-Hicks argues the district court erred in denying his application for post-conviction relief.
