Summary
Demetris Haney appeals from a criminal judgment entered after a jury found him guilty of aggravated assault, reckless endangerment, and terrorizing.
In January 2022, Haney was involved in a shooting at a bar in Dickinson. Haney testified two individuals shot at him and he returned fire, shooting five rounds toward one of the individuals. The State charged Haney with reckless endangerment, terrorizing, conspiracy to commit murder, and two counts of attempted murder. The State subsequently moved the district court to dismiss the conspiracy charge. In August 2022, the court held a three-day jury trial. The jury found Haney not guilty of attempted murder, but found him guilty of two counts of the lesser included offense of aggravated assault, guilty of reckless endangerment, and guilty of terrorizing. The jury also found he was a dangerous special offender. In December 2022, the court sentenced Haney.
On appeal, Haney argues the district court erred by denying his motion for acquittal, created a structural error by denying his constitutional rights to a public trial, and denied his right to due process.
