RULE 6.4 EXHIBITS

(a) Exhibits to Be Left With Clerk. All exhibits that have been offered or received in evidence must be retained by the clerk until 180 days after the case file is closed, unless otherwise directed by the court.

(b) Exhibits too Large for Filing. All physical exhibits, including books, maps, models, and documents, too large for convenient filing, offered by either party, may not be filed, but must be retained by the clerk until 180 days after the case file is closed.

(c) Return of Exhibits. A party seeking return of exhibits must file a document return request form as provided under N.D.Sup.Ct.Admin.O. 19 (Scanned Documents; Document Return).

Rule 6.4 was amended, effective March 1, 2012; June 1, 2025.

Rule 6.4 was amended, effective March 1, 2012, to specify time periods for retention of exhibits and the method for requesting return of exhibits.

Rule 6.4 was amended, effective June 1, 2025, to establish procedures for handling exhibits too large for filing and sensitive exhibits.
