RULE 705. DISCLOSING THE FACTS OR DATA UNDERLYING AN EXPERT'S OPINION
Effective Date: 3/1/2014
Unless the court orders otherwise, an expert may state an opinion, and give the reasons for it, without first testifying to the underlying facts or data. The expert may be required to disclose those facts or data on cross-examination.
Rule 705 was amended, effective March 1, 1990; March 1, 1997; March 1, 2014.
Rule 705 is based on Fed.R.Ev. 705.
Rule 705 was amended, effective March 1, 2014, in response to the December 1, 2011, revision of the Federal Rules of Evidence. The language and organization of the rule were changed to make the rule more easily understood and to make style and terminology consistent throughout the rules. There is no intent to change any result in any ruling on evidence admissibility.
