Administrative Rule 25 - AUTHORIZATIONS TO ADMINISTER OATHS

Under N.D. Const. art. VI, § 3 and N.D.C.C. § 44-05-01(7), the North Dakota supreme court promulgates this rule relating to officers authorized to administer oaths:

The following officers are authorized to administer oral oaths in recorded court proceedings:

1) Court Reporters;
2) Employees of the district court as designated by the district judge presiding at the proceeding;
3) Judicial Referees;
4) Magistrates; and
5) Employees of the clerk of district court.

Rule 25 was adopted September 1, 1987; amended effective January 1, 1995; March 1, 1995; August 11, 2021; July 1, 2026.

Rule 25 was amended, effective, July 1, 2026, to authorize municipal judges and municipal court employees to administer oaths.
