8th Circuit decides N.D. case Friday, July 16, 2021

The United States Court of Appeals for the Eighth Circuit has issued an opinion in a North Dakota case. The court held that entry of a preliminary injunction constitutes an "entry of judgment" triggering the fourteen-day deadline for filing a motion for attorneys' fees under Fed. R. Civ. P. 54; plaintiffs' motion was untimely under Rule 54 where the injunction was entered in August 2016 and the motion was filed in April 2018; the district court did not abuse its discretion in finding that plaintiffs' failure to comply with the filing deadline was the result of excusable neglect.
