8th Circuit decides N.D. case Monday, February 28, 2022

The United States Court of Appeals for the Eighth Circuit has decided a North Dakota criminal sentencing case. The court held that with respect to defendant's claim that the district court committed plain procedural error at sentencing by relying on previously undisclosed information, assuming, without deciding there was an error that was plain, defendant has failed to show the purported error affected his substantial rights; the sentence imposed upon the revocation of defendant's supervised release was not substantively unreasonable.
