8th Circuit decides N.D. case Tuesday, January 10, 2023

The United States Court of Appeals for the Eighth Circuit has issued an opinion in a North Dakota case.

In United States v. Greywind the court explained that, in an appeal challenging the district court's order requiring turnover of funds in Greywind's inmate account, the general payment scheme orally pronounced at sentencing only sets a minimum payment and must defer to the statutory scheme set out in 18 U.S.C. Sec. 3663(n); here, the funds at issue were COVID-related tax relief payments, and the district court did not plainly err in concluding the money was a non-exempt "windfall or substantial financial injection" and could be turned over to meet defendant's restitution obligation.
