8th Circuit issues opinion in N.D. case Thursday, January 27, 2022

The United States Court of Appeals for the Eighth Circuit has issued an opinion in a North Dakota firearms possession case. The court held that the district court, having a found a violation of the anti-shuttling provisions of the Interstate Agreement on Detainers Act, did not err in dismissing the indictment without prejudice; the violation was inadvertent and there was no evidence of bad faith or negligent pattern; the court did not err in determining the administration of justice would be better aided by not allowing defendant to escape prosecution on a serious charge because of a technical violation of the Act.
