Proposed North Dakota Rules of Court and Amendments to the Rules of Civil Procedure and North Dakota Supreme Court Administrative Rules, Relating to Alternative Dispute Resolution

On June 30, 1998, the Supreme Court received the Final Report of its Joint Dispute Resolution Study Committee, and subsequently referred it to the Joint Procedure Committee. The Committee considered the Final Report and recommended amendment to N.D.R.Civ.P. 16. The Court adopted that amendment effective March 1, 2000. The Court, on its own motion, now proposes Rules 8.8 and 8.9, North Dakota Rules of Court, and amendments to Rule 12, North Dakota Rules of Civil Procedure, and Rule 28, North Dakota Supreme Court Administrative Rules. A copy of the proposed Rules and Amendments is attached.

ORDERED, that a hearing be held on the proposed rules and amendments, September 6, 2000, at 10:45 a.m., in the Ralph J. Erickstad Courtroom of the Supreme Court, at the State Capitol in Bismarck, North Dakota. Time for personal appearances will be limited. Any person wishing to appear must notify Penny Miller, Clerk of the Supreme Court, at least three days prior to the scheduled hearing. Any person wishing to comment on the proposed amendments may do so in writing prior to the hearing. Address written comments to Penny Miller, Clerk of the Supreme Court, 600 E.
